Buying luxury property in Vienna: penthouse, Altbau or villa — what matters?

Luxury property in Vienna means above all penthouses and loft flats, generous Altbau (period building) flats on the Beletage, and villas in the Cottage and villa quarters of the 13th, 18th and 19th districts. Their price is usually well above the Vienna median price of €5,212 per square metre (Statistik Austria, 2025) and depends more than usual on location, view, outdoor space and legal position. Before a purchase, the building permit, conservation area, monument protection, zoning and — if the property is to be let — the Mietrechtsgesetz count for more than the fittings.

The essentials in brief

  • "Luxury property" is not a legal term: what counts is location, size, outdoor space, view, build quality and a price well above the average.
  • Typical locations: Innere Stadt, Döbling with Grinzing and the Cottage, Hietzing, the Cottage quarter of Währing and the diplomatic quarter in Landstraße.
  • Penthouse: check the building permit and the terrace's status in the Wohnungseigentum (condominium ownership); loft conversions with a building permit issued after 31 Dec 2001 are exempt from the rent ceiling of the Mietrechtsgesetz.
  • Altbau Beletage: conservation area, monument protection and, for letting, the Richtwert (€6.74/m² since April 2026) determine what you may change and what you may charge.
  • Villa: the Flächenwidmung (zoning) and the Bebauungsplan (development plan) decide whether you may extend or rebuild.
  • Incidental costs as with any purchase: 3.5% Grunderwerbsteuer, 1.1% for the Grundbuch entry, at most 3% commission plus VAT.
  • Agents must identify buyers and check the origin of the funds (the anti-money-laundering rules of the Gewerbeordnung).
Definition. A luxury property is a flat or a house whose price lies well above the market average because location, size, outdoor space, view, build quality and rarity come together. In Vienna these are above all penthouse flats, Altbau Beletage flats and villas.

Which locations count as luxury locations in Vienna?

The most sought-after locations for high-end living are in the inner city and on the edge of the Wienerwald. An average price per district is of little help here, because within a district individual streets set the price — which is why we describe locations rather than averages.

LocationTypical propertiesWhat buyers should watch
1010 Innere StadtAltbau Beletage, loft flats with a view of roofs and towersconservation area and UNESCO World Heritage status, lift, quiet towards the courtyard — district page
1190 Döbling (Grinzing, Cottage)villas, flats in villa buildings, new builds on the slopezoning, hillside position, garage — district page
1130 Hietzingvillas, Cottage-quarter Altbau, flats near Schönbrunnconservation areas, use of the garden — district page
1180 Währing (Cottage quarter)villas and Altbau flats in the Cottagebuilding regulations, green space
1030 Landstraße (diplomatic quarter)Altbau near the Belvedere and the embassiesconservation area, parking space — district page

Penthouse, Altbau or villa: what has to be checked?

With high-end properties the legal position decides the value more often than the fittings do. A terrace without a building permit, or an extension that contravenes the development plan, costs more on resale than any kitchen.

Type of propertyThe most important checkpoints
Penthouse / loft flatbuilding permit and completion notice for the conversion; the terrace entered in the Nutzwertgutachten as an appurtenance; lift running up to the loft floor; loft conversions with a building permit issued after 31 Dec 2001 are not subject to the MRG rent ceiling when let
Altbau Beletageconservation area and monument protection (alterations require consent); condition of roof, façade and pipework; level of the Rücklage and planned refurbishment; for letting, the Richtwert with surcharges and deductions
Villa / detached houseFlächenwidmung and Bebauungsplan (buildable area, height); monument protection; structural condition and Energieausweis; easements in the Grundbuch
New build in the luxury segmentbuilding and fit-out specification, instalment plan under the Bauträgervertragsgesetz — see New builds in Vienna
Definition. The Beletage is the first upper floor of a Viennese Altbau — usually with the highest ceilings, the largest windows and the most elaborate fittings in the building. In Gründerzeit houses it is traditionally regarded as the best flat.

Discretion and buyers from abroad

Many owners of high-end properties want their sale not to be publicly advertised. We present such properties to interested buyers after an initial conversation; the address and the photographs are passed on only then. For buyers that means part of the offer is not visible on portals.

If you buy from abroad, the same rules apply as for any Viennese property. Whether a foreign person needs approval depends on the federal state and on their personal status. In Vienna, EU and EEA nationals are in principle exempt from the approval requirement. Third-country nationals generally need approval; statutory exceptions and exceptions under international treaties must be checked in each individual case. Russian citizens are additionally subject to EU sanctions rules. The details are in the guide Buying property as a foreigner.

As estate agents we are obliged under the Gewerbeordnung (§§ 365m et seq.) to identify buyers and check the origin of their funds. Have your identity document and proof of financing ready — it speeds up the offer.

The process in six steps

Buying a luxury property follows the same legal process as any purchase in Austria. It often takes longer because the checks and the negotiations are more demanding.

  1. Initial conversation. Location, type of property, budget and timeframe; for buyers from abroad, the question of approval as well.
  2. Selection and viewing. Publicly listed and unlisted properties; documents in advance.
  3. Legal and technical review. Grundbuch, building permits, zoning, conservation area and monument protection, for flats the Nutzwertgutachten and the Rücklage, and a building surveyor on request.
  4. Negotiation and Kaufanbot. Price, handover date, inventory included in the sale, conditions such as financing or approval.
  5. Purchase contract and escrow. A notary or lawyer draws up the contract and handles payment through an escrow account.
  6. Grundbuch and handover. Entry in the land register, handover with a protocol, re-registration of energy supply and insurance.

What does buying a luxury property cost?

The incidental costs are the same as for any property purchase: around 10% of the purchase price. At high purchase prices they weigh more heavily in absolute figures.

ItemRateAt a purchase price of €2,000,000
Grunderwerbsteuer3.5%€70,000
Grundbuch entry1.1%€22,000
Agent commission (at most)3% plus 20% VAT€72,000
Contract drafting and escrowas agreed–

The agent commission is a maximum rate and may be agreed lower; with a new build from the developer it often does not arise at all. More under Agent commission and Incidental costs when buying property.

Frequently asked questions

What counts as a luxury property in Vienna?

There is no statutory definition. What is meant are flats and houses whose price, because of location, size, outdoor space, view and build quality, lies well above the Vienna median price of €5,212 per square metre (Statistik Austria, 2025) — typically penthouses, Altbau Beletage flats and villas.

Where are the best residential locations in Vienna?

For high-end living, the most sought-after are above all the Innere Stadt, Döbling with Grinzing and the Cottage, Hietzing, the Cottage quarter of Währing and the diplomatic quarter in Landstraße. Within these districts, individual streets and buildings decide the price.

What do I have to watch when buying a penthouse in Vienna?

The building permit and completion notice for the loft conversion, the fact that the terrace is allocated to the flat in the Nutzwertgutachten, and the lift. Loft conversions with a building permit issued after 31 Dec 2001 are exempt from the rent ceiling of the Mietrechtsgesetz when let.

Can I buy a villa in Vienna and rebuild it?

Whether and how you may extend or rebuild is set by the Flächenwidmung and the Bebauungsplan; if the house is under monument protection, every change needs the consent of the Bundesdenkmalamt. You should have both checked before the Kaufanbot.

Are luxury properties in Vienna also sold discreetly?

Yes. Many owners of high-end properties do not want a public advertisement. Agents present such properties to interested buyers after an initial conversation.

What incidental costs arise when buying a luxury property?

Around 10% of the purchase price: 3.5% Grunderwerbsteuer, 1.1% for the Grundbuch entry, at most 3% agent commission plus VAT, and contract drafting and escrow. At a purchase price of €2 million, tax and land register alone come to €92,000.

May foreigners buy luxury property in Vienna?

Whether a foreign person needs approval depends on the federal state and on their personal status. In Vienna, EU and EEA nationals are in principle exempt from the approval requirement. Third-country nationals generally need approval; statutory exceptions and exceptions under international treaties must be checked in each individual case. Russian citizens are additionally subject to EU sanctions rules.

Why does the agent ask where my money comes from?

Estate agents are obliged under the Gewerbeordnung (§§ 365m et seq.) to prevent money laundering: they must identify clients and check the origin of the funds. That applies to every purchase, and at high amounts the check is more thorough.
