Letting a flat in Vienna: what does the agent do, and what does it cost?
ImmoLöwin GmbH lets flats in Vienna and Lower Austria on the owners' instructions: we check what rent is legally permissible, produce the listing and the photographs, run the viewings, check the applicants' creditworthiness and prepare the tenancy agreement. A fee arises only if a tenancy agreement comes about; it is agreed in writing beforehand and stays within the statutory ceiling of three gross monthly rents plus VAT.
The essentials in brief
- For rented flats the Bestellerprinzip (the "whoever orders, pays" rule) has applied since 1 July 2023: if the owner engages the agent, the owner pays, not the tenant (§ 17a MaklerG).
- The agent may charge the landlord at most three gross monthly rents plus 20% VAT.
- The fee falls due only if the tenancy agreement takes legal effect (§ 7 MaklerG).
- Whether a freely agreed rent is permissible or the Mietrechtsgesetz (Tenancy Act) sets limits — the Richtwert (statutory reference rent), the category system — depends on the year of construction, on subsidies and on the fit-out. We check that before the listing goes out.
- The listing must state the energy indicators required by law; the Energieausweis (energy performance certificate) must be presented in good time before the buyer or tenant makes a binding contractual declaration — i.e. before a binding purchase offer (Kaufanbot) — and handed over after the contract is concluded.
- We broker only in Austria and advise in German, Russian, Ukrainian and English.
What does the agent do when letting a flat?
The agent takes off your hands the work between an empty flat and a signed tenancy agreement. What decides the outcome is less the listing than two checks: what rent is legally permissible, and whether the tenant can pay it for the long run.
| Step | What we take on |
|---|---|
| Rent | Checking whether the Mietrechtsgesetz applies in full, in part, or whether the rent is freely agreeable; a recommendation for a rent that is both marketable and legally sound |
| Documents | Energieausweis, floor plan, statement of operating costs, and for a flat in Wohnungseigentum (condominium ownership) the house rules |
| Marketing | Photographs, listing on the large portals and in our client register |
| Viewings | Pre-selection against your criteria, appointments, showing the flat on site |
| Choosing the tenant | Proof of income, employment, a credit report where needed; you decide |
| Contract | Preparing the tenancy agreement, the deposit, the handover protocol with meter readings |
What does letting with an agent cost?
You pay only if a tenancy agreement comes about. We agree the level of the fee in writing before we start; the law permits at most three gross monthly rents plus 20% VAT from the landlord.
For the tenant the flat is commission-free. An agreement that nevertheless imposes a commission on the tenant would be void under § 17a MaklerG. All the maximum amounts at a glance: Agent commission in Austria.
How the letting works, step by step
From the instruction to the handover of the keys there are six steps:
- First conversation and viewing of the flat. We look at the condition, the fit-out and the documents.
- Rent check. We establish what rent is legally permissible and achievable on the market.
- Agency agreement. We record the fee, the term and your criteria for tenants in writing.
- Listing and viewings. Photographs, listing, pre-selection of applicants, appointments.
- Choosing the tenant. We put checked applicants in front of you; the decision is yours.
- Tenancy agreement and handover. Contract, deposit, handover protocol with photographs and meter readings.
What rent is permitted in Vienna?
That depends on the building, not on the market alone. In period buildings with a building permit issued before 1945 and in subsidised buildings, the Mietrechtsgesetz usually applies in full, with a Richtwert rent; in many new buildings and in owner-occupied flats in new buildings a freely agreed rent is possible. A rent set too high can be reclaimed by the tenant years later before the Schlichtungsstelle (arbitration board) — which is why we check this before the listing, not after. Frequently asked questions
Who pays the agent when I let my flat?
The owner who engages the agent. Since 1 July 2023 the Bestellerprinzip has applied to rented flats in Austria; for the tenant, a flat offered on the owner's instructions is commission-free.
How much commission may an agent charge the landlord?
At most three gross monthly rents plus 20% VAT. At ImmoLöwin the fee is agreed in writing before we start and falls due only if a tenancy agreement comes about.
When do I have to pay the fee?
Only once the tenancy agreement has been validly concluded. If no tenant is found, you pay nothing.
How long does it take to let a flat in Vienna?
That depends on location, condition and the level of the rent. A realistically set rent is the single most important factor for a quick letting — which is why we begin with the rent check.
May I ask any rent I like in Vienna?
No. In period and subsidised buildings the Mietrechtsgesetz limits the rent, usually through the Richtwert. A freely agreed rent is possible above all in newer, unsubsidised buildings.
Which documents do I need in order to let?
An Energieausweis, a floor plan, a statement of the operating costs and, for flats in condominium ownership, the house rules. The listing must state the energy indicators required by law. Since 1 July 2026, § 3 EAVG names the heating demand, the final energy demand and the overall energy efficiency class; for existing energy performance certificates, § 10a still permits HWB and fGEE. The Energieausweis itself must be presented in good time before the buyer or tenant makes a binding contractual declaration — i.e. before a binding purchase offer (Kaufanbot) — and handed over after the contract is concluded; statutory exceptions remain unaffected.
Who decides whom the flat is let to?
You do. We check the applicants' income and documents and put a selection in front of you; the decision rests with the owner.
Do you also let in Lower Austria?
Yes. ImmoLöwin lets flats in Vienna and Lower Austria, particularly in the Bezirk Korneuburg and in the belt around Vienna. Our office is in Langenzersdorf.
