The most common mistakes when buying property – and how to avoid them

The most expensive mistakes when buying property in Austria usually happen where buyers rely on verbal assurances instead of documents: an unchecked C sheet in the land register, unclear zoning, surprise service-charge back-payments or a reserve fund that is too low. Systematically checking the documents before the purchase offer uncovers most of these risks.

Key points

  • Land register C sheet not checked → overlooked mortgages, prohibitions on encumbrance and sale, or easements.
  • Zoning not checked → restrictions on use or future conversion, especially for houses with land.
  • Service-charge statement not seen → unexpected back-payments.
  • Reserve fund too low → the statutory minimum contribution from 1 January 2026 is €1.12 per m² of usable floor area per month, but in older buildings it is often not enough for upcoming repairs.
  • Nutzwert not questioned → affects cost sharing and voting rights.
  • Energy certificate missing or out of date (no more than 10 years old).
  • No financing condition in the purchase offer → a risk if the bank says no.
  • Deadlines missed – such as the one-year priority reservation or withdrawal periods.

Mistake 1: not checking the land register C sheet

The C sheet (C-Blatt) of the land register lists the encumbrances on a property: mortgages, easements (such as rights of way), prohibitions on encumbrance and sale. Anyone who only looks at the B sheet with the owner can easily miss an old loan or a third party's right of first refusal or right of residence. How to check: get a current land register extract via JustizOnline and read the C sheet especially carefully – see Land register entry: time and cost.

Mistake 2: not checking the zoning

With houses in particular, the zoning (Widmung) decides what may be built or converted. A plot in green land rather than residential building land can wreck a buyer's plans. How to check: the zoning plan at the municipality; in Vienna, online from the City of Vienna.

Mistake 3: not looking at the service-charge statement

The last annual statements show whether back-payments were regularly needed and what the running costs really are – figures in the listing are often flat estimates. How to check: ask the seller or the property management for the last one or two annual statements.

Mistake 4: a reserve fund that is too low

The reserve fund (Rücklage) is the owners' association's legally required financial cushion for future maintenance work on the building. The Condominium Act sets a minimum contribution per square metre of usable floor area, adjusted every two years to the consumer price index; according to the professional association of property agents and managers (WKO), it is €1.12 per m² per month from 1 January 2026. A low reserve in an older building is a warning sign of upcoming uncovered costs (roof, façade, lift). How to check: ask the property management about the reserve balance and planned works, and read the minutes of owners' meetings.

Mistake 5: not questioning the Nutzwert

The Nutzwert is the figure that expresses the value of a condominium unit relative to the other units in the same property – it is derived from the usable floor area with additions or deductions for position, balcony, cellar and the like. In principle it determines the share of costs and the voting weight in the owners' association. An unusually high or low Nutzwert compared with similar units in the building deserves a question.

Mistake 6: energy certificate missing or out of date

The energy certificate (Energieausweis) is mandatory when selling and may be no more than 10 years old. A missing certificate is not just a formal error – it often hides real heating costs. Details: Selling a house in Vienna and Lower Austria.

Mistake 7: no financing condition in the purchase offer

Anyone who signs a purchase offer without a financing condition – that is, without the condition that the purchase only takes effect if financing is approved – risks a contractual penalty or losing a deposit if the bank declines. How to avoid it: get a financing commitment before the offer, or have a clear condition included. A first calculation: the Loan calculator.

Mistake 8: missing deadlines

These include the one-year effect of the priority reservation (Rangordnung) and withdrawal periods under the agency agreement or for distance contracts (see Hiring an estate agent).
